High Court notice to State, MCI and COMEDK

Bangalore, Jan 28, 2013, DHNS:

The High Court on Monday issued notices to the State Government, the Medical Council of India (MCI) and the Consortium of Medical, Engineering and Dental Colleges of Karnataka (Comed-K) following a public interest litigation seeking a curb on seat-blocking racket in admissions to professional colleges.

The petition filed by Prof Ambalike Hiriyanna said 24 students had blocked medical seats for gain and, eventually dropped out of the Kempegowda Institute of Medical Sciences (KIMS).

Petitioners also sought a detailed probe in to the issue. A division bench comprising acting Chief Justice K Sreedhar Rao and Justice Abdul Nazeer issued notices and directed them to file objections with a week.

Petitioners alleged that the seat-blocking row rampant in allotment of medical seats in the State. As per a clause in the consensual agreement of the State government with the professional institutes, all unfilled government quota seats have to be surrendered back to college managements.

The managements eventually convert them to “management quota” seats.

Some merit students fall prey to the management lobby and take part in the seat-blocking racket, said the petitioner.

Medical Council of India bars varsities from starting PG, post-doctoral courses: TOI

BANGALORE: In a blow to lakhs of doctors across the country, the Medical Council of India (MCI) has barred all health universities from starting any post-graduate or post-doctoral certificate course this year.

The PDCC courses can be done by doctors with an MD to enable them to perform specialized procedures. "For instance, a doctor cannot perform an angiogram unless she has completed this 18-month fellowship or the PDCC course.

Banning this would prevent us from conducting this critical procedure. At a time when there is a shortage of specialists, it's ridiculous that the MCI has come up with this rule," a vice-chancellor told TOI on condition of anonymity.

Health universities across the country have been offering PDCC courses for over two decades. "We're shocked. After allowing state universities to conduct the certificate courses for nearly two decades, it's uncertain as to what pushed the MCI to issue such a directive which will affect access to healthcare. We have no reason to believe it's the lack of confidence in universities' abilities to run such courses," said the CEO of a university.

With each of the 500-odd institutions in the country offering these courses and having their own academic calendar, the MCI's directive will throw their schedule out of gear. "About a thousand seats will go abegging this year as universities cannot admit students till the MCI completes its inspection,'' he said.

Doctors are upset by the MCI's move to control health universities. "On the one hand, the UGC wants to start innovation universities to encourage innovation in institutions of higher learning. But you have MCI which wants to control its universities. This will only threaten the autonomy of universities. There will be an overlap of authority and functional autonomy given by state governments to medical university. By centralizing every aspect of medical education, MCI will only stifle innovation and significantly affect the creation of specialized medical professionals," sources said.

Doctors and university heads say this will only reduce the number of specialists. "The aging population in India is on the rise. We need health universities to start fellowship courses in geriatric medicine to treat the aged. The MCI should only monitor medical education. It shouldn't interfere in structuring of courses; that's not its job," said a vice-chancellor.

Last day of NEET PG hearing, do u expect a final verdict today?

Well today is Jan 17th, the said last day for the hearing in SC on the matter of NEET PG and private and minority institutes being included in NEET. Many things depends on today.

  1. Validity of NEET for next year.
  2. Result of NEET to be released.
  3. So many exams of private institutes.
  4. And ofcourse the future of thousands of medicos.

These are some of the highlights of hearing on 16th Jan 2013

  • Senior Lawyers appearing on behalf of CMC Vellore argued that their institution is 100 years old and India's leading medical institution compared to AIIMS and they are giving stipends to the doctors and they absorb them in their own institutions .
  • They also quoted some previous supreme court orders and mentioned that minority institutions are guarded by constitutional rights and MCI has no jurisdiction over the admission process of minority institutions.
  • They also quoted 1997 supreme orders which says minority institutions have the full rights over the admission process.
  • Argument will be continued by the senior most lawyers of other minority institutions tomorrow.
  • Hearing ,likely to be continued next week also, pertaining to institutions governed by other private universities and state governments.
So after seeing the progress of events, do you think the final verdict will be out today, well i doubt it!!

Please post your comments.

Previously SC in the Interim Order has allowed the private colleges and state govt to conduct their separate entrance exams, which created a lot of agitation among medical students community. Many medicos associations have been made at different parts of the county to fight against the Interim Order.
