Applicability of Neet in Andhra Pradesh 




The National Eligibility cum Entrance Test (NEET) is mandatory for admissions to undergraduate and postgraduate courses in all the Government and private medical colleges that come under the ambit of the Indian Medical Council (IMC) Act, 1956.

The States of Andhra Pradesh, Tamil Nadu and UT of Puducherry have requested for exemption from NEET. The States of Andhra Pradesh and Tamil Nadu have filed writ petitions in the respective High Courts seeking exemption from NEET. These petitions alongwith other similar peritions filed by a number of private medical colleges/institutions have been transferred to the Hon’ble Supreme Court of India and the matter is sub-judice.



Though Andhra Pradesh and Jammu & Kashmir have special provisions under the Constitution, there is no conflict between these provisions and IMC Act, 1956 or NEET regulations made there under, which are enacted having regard to entry 66 List I of Seventh Schedule of the Constitution.



In view of the order dated 13.12.2012 of the Hon’ble Supreme Court of India in T.C. Case No. 101 of 2012 and connected cases, permitting the Medical Council of India and Dental Council of India as well as the States and Universities and other Institutions to conduct their respective examinations for MBBS, BDS and Postgraduate courses and restraining them from publishing the result till the outcome of pending cases, it is open for the students from Andhra Pradesh to appear in NEET-2013 or EAMCET or both.



This information was given by Minister for Health & Family Welfare Shri Ghulam Nabi Azad in written reply to a question in the Rajya Sabha today.
